Separation and Parenting Agreements

A legal contract between separating partners or parents that outlines how they will divide property, handle finances, manage other responsibilities after separation, and how they will raise their children, including custody, visitation, and decision-making arrangements.

A separation or parenting agreement is a written contract between two spouses or parents who have decided to live apart. It’s a way to put important decisions in writing so that both of you have clear expectations and a plan moving forward.

Your agreement can cover things like:

  • How property, money, and debts will be divided

  • Where the children will live and how parenting time is shared

  • Child support or spousal support (alimony)

  • Who will be responsible for household bills, insurance, and other expenses

 

Think of it as a roadmap that helps reduce conflict and uncertainty during a difficult time. Instead of leaving decisions up to a judge, you and your spouse can work out solutions that fit your family’s unique needs.

A separation or parenting agreement does not end your marriage—that only happens through an absolute divorce—but it does give you a legally binding plan for how life apart will look in the meantime.
